What Is the SB 729 Mandate?
Starting January 1, 2026, the mandate requires eligible large-group, fully insured health plans in California to provide comprehensive coverage for the diagnosis and treatment of infertility. SB 729 moves past older, restrictive definitions of infertility. Instead, it ensures inclusive access for LGBTQ+ individuals, same-sex couples, and single parents by choice, without requiring individuals to prove a pre-existing medical condition.
Key provisions covered under SB 729 include:
- Infertility Diagnosis and Treatment: Comprehensive diagnostics and personalized treatment planning.
- In Vitro Fertilization (IVF): Coverage for up to 3 completed egg retrievals and an unlimited number of embryo transfers, subject to clinical guidelines.
- Fertility Medications: Coverage for medications required for these procedures.
- Fertility Preservation: Coverage for medically necessary procedures, such as oocyte freezing prior to cancer treatments.
Does Your Plan Qualify?
The mandate applies to fully insured employer plans with 101 or more employees regulated by the California Department of Insurance and the Department of Managed Health Care.
